At Prosperiqa S.A. (hereinafter, "Prosperiqa", "we" or the "Platform"), with registered office at Av. Corrientes 1234, Floor 8, C1043AAZ, Autonomous City of Buenos Aires, Argentine Republic, we value your privacy. This Privacy Policy explains how we collect, use, protect and share your personal data when you visit prosperiqa.com or use our real estate crowdlending services.
1. Data controller
The controller of your personal data is Prosperiqa S.A., CUIT 30-71789456-3, registered with the General Inspectorate of Justice under No. 12,348 of Book 91, Volume A, Joint-Stock Companies. We comply with Argentine Personal Data Protection Law No. 25,326 and concordant regulations.
2. Data we collect
We collect the data you provide when you fill in subscription forms (name, surname and email), when you contact our team or when you register as an investor (ID/CUIT, address, banking details, investor profile). We also collect technical browsing data: IP address, device type, language, pages visited, date and time of access and cookie identifiers.
3. Purposes of processing
We process your data to: (i) manage your subscription and send you information about real estate investment opportunities; (ii) activate your investor account when applicable; (iii) comply with legal and regulatory obligations before AFIP, UIF and CNV; (iv) analyse the use of the site to improve the experience; (v) prevent fraud and protect platform security.
4. Legal basis
Processing is based on your free, express and informed consent given when accepting this Policy, on the performance of the contract when you are an investor, on applicable legal obligations (Law 25,246 on Money Laundering, CNV regulations) and on the legitimate interest of Prosperiqa to improve its service.
5. Data retention
We keep your data while our relationship with you continues and, afterwards, for the applicable legal periods (minimum ten years for financial and tax matters) or until you request its deletion, unless legal obligation requires otherwise.
6. Recipients and transfers
We may share data with technology service providers (cloud hosting, analytics, email), participating financial institutions, legal advisors and competent authorities (AFIP, UIF, CNV, Courts). For international transfers, we require adequate safeguards under DNPDP Provision 60-E/2016.
7. Data subject rights
As a data subject, you may exercise at any time the rights of access, rectification, update, deletion and objection provided by Law 25,326. To do so, write to privacy@prosperiqa.com with your full name, ID and the right you wish to exercise. We will reply within the legal terms (10 calendar days for access). The AAIP (Agency for Access to Public Information) is the supervisory authority.
8. Security
We apply reasonable technical and organisational measures, including in-transit encryption (TLS 1.3), access control, backups and periodic audits, to protect your data against unauthorised access, loss or alteration.
9. Minors
Prosperiqa does not offer services to minors under 18 years of age. We do not knowingly collect data from minors.
10. Changes to this policy
We may update this Policy to reflect legal changes or changes to our services. We will publish the current version with the last updated date on this same page.
